I had to go through the same process last year. The day i went for the interview, there were 3 other PhDs with me to get their H1B stamped. It took me 7 weeks to get the passport back and for others it took longer. Calling embassy will not expedite the process. Call Department of State and ask for the update. I know its frustrating.

Restarting wouldn't be a bad idea in my case as i'm EB3 ROW and i do have an approved I140 on EB3.
But in my case i have over 4 years of work experience, but do not have a masters degree, so any idea if that is possible ?
My gut feeling is that regardless if i'm not able to qualify for EB2, my PD JUN 2006 will get current in a couple of months - just hopefull :rolleyes:

I would not get married until I have the GC in hand. In the mean time ask your gf/fiance to start her GC process thro employer. Once you have your GC, you can get married and apply for her GC. Whicher way her GC comes first - i.e. through employer sponsored or through your sponsorship, go with that. I think its taking around 3-4 years for GC to sponsor their spouse.

I am in company A on H1B and doing H1B transfer to Company B.
Company B is saying that I can join the same day on which the H1B transfer packet is received by USCIS.
if the docs are delivered on SEP 01 2009 can I join on the same day, or I should join from SEP 02 2009

Enter your employer's name and address in question number 15. The advice you have got from the IO is not correct. You will not be put into deportation the moment you lose your job. You have time to either transfer your H1 or file a petition for a change of status to another classification.

Anytime your place of work changes on H1, your company should file an amendment to the H1B labor certification stating your new place of work.
Hopefully, the officer at the consulate wont ask and you wont have a problem.
Personally, I have my client's location as well as my company's location on my H1 LCA.

I dont think we are doing any wrong here. I think it helps people. People can search who are the H1B and GC sponsoring companies. You can search about lawyers who have filed H1B and Green Cards.

I am planning to visit India during May 2011. I am working in multinational company as civil engineer (on H1-B). I have PhD from US uni. I am reading a lot about visa stamping probs these days. I changed my job recently, I'm starting up with new GC application with my new employer as I had passed only 140 stage with my previous GC application of employer and I couldn't get a chance to file my 485. I have 12 plus years of total IT experience. My question is related to the section in the PERM application for my major field of study. I have a Bachelor's degree in civil engineering from good university in India , finished in 1996. My academics and work experience were assessed with US equivalent study and it's evaluated as Bachelor's degree in Computer Information Systems by qualified and expertized education evaluator. My current company lawyer told me that he would mention it as Computer Information Systems in my PERM application. Is it correct to mention in my perm application for my major field of study as Computer Information Systems?
I will greatly appreciate your valuable suggestions.

It's only IV members. We did decide on few things last time, We have some new ideas, to talk. I have a new job offer and the employer is willing to sponsor my GC in EB2 category. The job requires BS+5 years experience which I have.
Question: If the old employer revokes my I-140 before the new employer files new PERM and I-140 under EB2 category, can I still port my EB3 priority date to EB2?
According to a well known lawyer in LA area, you can port dates even if your 140 is revoked by your employer. The only possible cause not allowing you to port dates would be revoking of your 140 by USCIS if they feel there was a fraud in your case.

When the tech companies/competeamerica.org are bragging that retrogression is anti competitive and severely constraining the growth of the techies/employees, why can�t an antitrust lawsuit stand good in US courts?
Can somebody shed more light on this and explain why any lawsuit wont work against retrogression and/or for issue of EAD after I-140 approval, when retrogression is anti-competitive.

My passport is expiring in March. I live in NY metro . Does anyone knows the procedure to renew the passport while in the USA. Please share your experience.

Also, there were atleast 2 threads discussing PP renewals..You can do a search for those threads for renewal timelines...I think it takes them 2-3 weeks in NY Consulate to mail the new passport....You can go for tatkal service and get it issued the same day if you pay $90 extra....

Hi All,
I have filed an extension for my parents B2 Visa. I have got extension approval but only got I-94 for father and did not find I-94 for mother. I did attach Supplement-I with my mother's details.
I just happen to look at my application, I-539. I found that I checked the following:
Members of my family are filing this application with me.
The total number of people (including me) in the application is: 1
Is it customary that I only receive I-94 for the principal applicant (in my case) and don't have to worry about?
If not, please share your thoughts. Do I need to file seperate application for my mother at this point?
