    I just got my labor approved for Masters degree and 3 years exp.

    I have 3 years B.Sc degree and 3 years MCA degree from India and my education eval. shows it as equivalent to MS in computer Science.

    In form ETA 750, under section 14, I have following data

    College degree required:
    Master of Science

    Major field of study
    Comp Sci/Engg,Info Sys Engg

    Experience
    3 years

    Other fields under section 14 and 15 are blank.

    RIR Advertisement has mentioned following
    " Must have MS in Computer Science or Engineering, Information Systems Engineering or foreign degree equivalent with 3 years of relevant work experience."

    I am little confused about "College degree required:" field. It only says "Master of Science". Should it be "Master of Science Or foreign equivalent"?

    I don't want to scare you, but I think the words "or foreign equivelant" is required unless you have a US degree.

    Please speak to your attorney about this.

    From what I read in the article they are talking about chaging 'the place of incorporation' from Bermuda to Ireland to avoid paying higher taxes through the proposed tax legislation ...dosent't talk about relocating all operations to Ireland

    EB1 was applied under the Extraordinary ability. I also have a EB2-NIW I-140 cleared as well. Hope that answers your question.

    As far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........

    Yes, Im aware of the Cronin memo, and also the clarification on murthy.com below

    But, If you read the memo correctly, the language is vague at best, with references to a final rule that I couldnt find. Even the interim memo(Cronin) isnt available from the USCIS website.

    My goal was not to restart the discussion on this. I simply wanted suggestions on how to approach USCIS to get clarity on this situation. Some options would be

    1. Call USCIS : but do the people answering the call know the rules, and is their "interpretation" valid ?

    2. Get an Infopass appt: Again, an IO may not be the right person responding to this

    3. Contact the USCIS director : possible? how?

    4. Contact AILA

    5. Contact the Ombudsman

    If anyone has thoughts and suggestions about how to get this clarified, please advise. My goal is to get a document from USCIS authoritatively stating their stance on this situation.

    PD isn't current, but just check i-485 online status, showing "Document production or Oath Ceremony" (i.e., the last cycle).

    There was indeed a soft LUD in June this year. After that nothing much else. Is there sth good coming along my way?

    Appreciate if anyone here can share his/her thoughts/comments.

    Don't rely on online status, take infopass and check it out. BTW, it is most likely a FP notice, not an approval.

    On page towards the bottom it prompts the doctor to enter details of the tb skin test.
    Did u actually take the test? If you did, then perhaps ur doc missed it.

    If i remember correctly, the doc i went to gave us two copies of the form, one that was sealed for uscis and the other for our reference. Anyway, if they dont have a copy of it, get a new one and make sure this info is filled out and any attach any additional relevant doc and send it to uscis.

    If u got a lawyer, i suggest you get them to send the info with an attached letter etc.

    It would be interesting to split the poll as: Apr-May, June-July, Sept-Oct and Nov-Dec 05. I know there r not many between apr 05 and sept 05. but there is a lot in mar05 and sept to dec05 as labors under perm started clearing after sept 05.

    Hello Everyone! Please advise me on the following agreement.

    I am currently working with green card sponsored employer on H1B (I have my EAD). I have my I485 pending with I140 approved and its been more than 180 days since my I485 has been pending. I am looking to use AC21, but concerned with the following agreement. Is this enforceable? Its been couple of years since I signed this and I know it's still a long wait before my I485 is approved. Please advise.

    This Addendum (part of the signed Employment Agreement by both parties) made as of - day of - by - and between XXXX company (hereinafter refereed to as "Employer") and - residing at - (hereinafter referred to as "Employee")

    Employer has processed Green Card for the Employee. Employee agrees to work for a minimum of 6 months (Client Billable hours) with Employer after Employee gets his/her Green Card approved, sponsored by Employer. Employee agrees to pay $10,000 to Employer in case if Employee does not work with Employer for 6 months after getting the physical Green Card.

    In the event that Employer commences litigation to enforce its rights under this Addendum and the Employment Agreement, Employee agree to pay for all filing fees, court costs, and Attorney's fees. In addition, should Employer incur pre-litigation costs in enforcing the Addendum, including but not limited to reasonable collection agency fees or pre-litigation attorneys fees and costs, then Employee agrees to reimburse Employer for all said costs incurred.

    Governing Law: The laws of Common Wealth of Virginia shall govern this Addendum. Any litigation in connection herewith shall be brought in the state of federal courts for Fairfax, VA and both parties consent to such court's exercise of personal jurisdiction over them.

    Employee represents that he/she has read and understand the terms of this Addendum, has had an opportunity to ask questions and to review this Addendum with legal counsel of his/her choice, is not relying on any advice from Employer in this regard, and is voluntarily signing this Addendum.

    I just have one more question, i also have my I-485 filed. We have given our fingerprinting tests but there has not been further progress. But would these double receipts have any effect on my I-485 process?
